The terms "you," "your," "User," "Authorized User," or "customer" refer to any individual or entity who accepts this Agreement, has account access, or uses our Services. By accessing https://www.PrivDot.com, you acknowledge and agree to these terms of service and all relevant laws and regulations. You assume full responsibility for complying with any applicable local laws. If you do not accept any of these terms, you are not authorized to use this website. The content on this website is safeguarded by copyright and trademark laws.
You are granted a temporary, non-exclusive license to download one copy of the materials (information or software) found on the PrivDot website for personal, non-commercial use only. This license is intended solely for viewing purposes and does not transfer ownership. By obtaining this license, you agree not to: (a) Modify or copy the materials. (b) Use the materials for any commercial or public display purposes, whether commercial or non-commercial. (c) Attempt to decompile or reverse engineer any software present on the website. (d) Remove any copyright or proprietary notices from the materials. (e) Transfer the materials to another person or host them on another server. If you violate any of these restrictions, this license will be automatically terminated, and it may also be terminated by PrivDot at any time. Upon termination of the license or your viewing of the materials, you must destroy any copies of the materials you have, whether in electronic or printed form.
At any time and without prior notice, PrivDot reserves the right to modify the contents of its website. However, it cannot guarantee that the materials will be kept up-to-date.
PrivDot is authorized by the Customer and Authorized User to act on their behalf and make takedown requests. In order to protect content, the Authorized User must provide the necessary information and comply with DMCA takedown process laws and regulations. Verification checks may be conducted by PrivDot to confirm the Customer and Authorized User's ownership of the content, which could include public database searches, financial and company records, and requests for license and rights holder agreements. The Customer and Authorized User confirm that they either own the intellectual property rights in the content or have been given a license to enforce these rights on behalf of the rights owner.
During PrivDot's 7-day free trial, you can delve into the platform's protective services. Please be aware that our free trial is offered only when it's clearly mentioned in the pricing section on our website. Once the trial concludes, automatic enrollment in your chosen paid subscription plan takes place without prior notification, and the subscription fee is promptly charged post the 7-day trial. If, at any point during the trial, you determine that PrivDot isn't the right fit for you, cancellation is an option, ensuring you won't incur charges for the subsequent billing cycle. Notably, not all features may be available during the trial period, with the complete suite of PrivDot's offerings unlocking when transitioning to the paid subscription.
PrivDot may make changes to these General Terms and Conditions, which will apply to any existing agreements. Customers will be informed of these changes through written or email communication, and the changes will become effective 10 days after the notification or on a later specified date. If the changes have a negative impact on the customer, the customer has the right to terminate the affected agreements effective from the date the new conditions come into effect.
PrivDot does not have responsibility for the content of any linked site that is not part of its own website, as it has not examined all the linked websites. The presence of a link on the PrivDot website does not indicate that PrivDot endorses or is affiliated with the linked site. Therefore, any use of or reliance on any information, materials or services provided by a linked site is done at the user's own risk, and the user should review the terms and policies of the linked site before accessing it.
Confidential information may be shared by both parties to fulfill their obligations under the agreement. However, such information shall not be considered confidential if: (a) it becomes publicly available without any involvement of the receiving party; (b) the receiving party had access to it prior to it being shared; (c) it was shared by a third party who had no confidentiality obligations; or (d) the receiving party created the information independently, as evidenced by written documentation.
These terms of service will be interpreted and enforced in accordance with the laws of the jurisdiction where PrivDot operates. The choice of law rules will not apply.
The PrivDot website's Services page and Authorized User pages both have a Pricing section. Payment of the Fees for the Services as outlined in the Order shall be made by the Customer to PrivDot in the currency specified in the Order. Authorized Users must use Stripe as the payment method and abide by Stripe's terms and conditions. Once a payment has been made for a service, it is considered non-refundable. PrivDot reserves the right to modify its pricing for services at any time. If there is a price increase, the Customer will receive a 10-day notice via email. If the Customer does not agree to the price increase, they can terminate the agreement by giving written or email notice. The termination will take effect on the date the increase becomes effective, and no charges will apply.
The subscription plans provided by PrivDot are intended for a single brand or content creator and cannot be shared or used by multiple entities. By using the service, Authorized Users allow PrivDot to scan, temporarily save, and display online content related to their brand or content creation. This is done to aid in the protection of content and the preservation of brand integrity. The term "unlimited" used in plan descriptions with regard to takedown requests or content removals means that there is no fixed limit for these actions. However, the availability of PrivDot's resources at any given time may affect the number of requests that can be fulfilled, and PrivDot reserves the right to limit requests according to available resources.
PrivDot will not be responsible for any kind of indirect or unexpected damages, like lost profits or data, or harm to goodwill that you might suffer from using (or not being able to use) our services. This includes any issues caused by third-party actions, any content you get through our services, and unauthorized use or changes to your data or content. Also, we try our best to provide accurate reports, but we can't promise they will always be perfect. We suggest you double-check the information in these reports. PrivDot won't be responsible for any actions you take based on these reports.
PrivDot respects the intellectual property rights of others, and we expect you to do the same. When you use our service, you don't give up any ownership rights to the content you share. However, you do give us permission to use, change, show, copy, and share your content as part of our service. Please make sure you only use content that you own or have permission to use, and don't infringe on anyone else's intellectual property rights with our service.
Users can manage their subscriptions through the "Manage your Sub." section on the dashboard or by contacting us via email ([email protected]) for any assistance. Please note, if you cancel, your service remains active until the end of the current subscription period. We do not issue refunds for payments already made for the upcoming billing period. Please note, PrivDot does not send out payment notifications before each billing cycle.
If you or anyone using your account breaks these terms and conditions, misuses our service, or behaves wrongly, and this leads to legal action or claims against PrivDot, you agree to cover all related costs, like legal fees. This means you're promising to protect PrivDot, its partners, employees, and other related parties from any legal consequences of your actions or the actions of people using your account.
